Terms of Service for RCR Plumbing LLC
Effective Date: November 3, 2026 Last Updated: November 3, 2026 Website: https://www.rcrplumbingllc.com/
Welcome to https://www.rcrplumbingllc.com/ (the "Site"), operated by RCR Plumbing LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our Site, as well as all plumbing, gas fitting, diagnostic, emergency, and maintenance services provided by RCR Plumbing LLC (collectively, the "Services").
By accessing or using our Site, requesting an estimate, booking an appointment, or authorizing Services, you ("Customer," "you," or "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Site or engage our Services.
1. Scope of Services & Licensing Credentials
RCR Plumbing LLC is a fully licensed and insured trade contractor operating in the Commonwealth of Virginia.
- Licensing: Virginia Board for Contractors Class A Contractor (License #2705-XXXXXX).
- Trade Designations: Certified Virginia Master Plumber and Master Gas Fitter.
- Service Area: City of Roanoke, City of Salem, Town of Vinton, Roanoke County, Botetourt County, and designated surrounding communities.
All Services are performed in compliance with the Virginia Uniform Statewide Building Code (USBC) and local municipal ordinances governing plumbing and fuel gas installations.
2. Estimates, Diagnostics & Work Authorizations
A. Initial Online & Phone Inquiries
Any pricing or timelines discussed over the telephone, through email, or generated via our online estimate request forms are non-binding informational estimates. Because plumbing systems involve concealed physical conditions (e.g., pipes inside walls, underground laterals, under concrete slabs), exact pricing requires an on-site physical diagnostic evaluation by a licensed technician.
B. Diagnostic Fees & On-Site Assessments
- Standard diagnostic or dispatch service call fees will be communicated prior to dispatch.
- Upon arrival, our technician will inspect the system, identify the issue, and provide an upfront, flat-rate written estimate for your approval before commencing repair or installation work.
- Diagnostic dispatch fees are non-refundable once a technician arrives at your property, regardless of whether you choose to proceed with recommended repairs.
C. Change Orders & Unforeseen Conditions
Plumbing work—especially in older Roanoke homes—frequently encounters concealed defects that cannot be identified prior to physical disassembly or excavation (e.g., corroded cast iron stacks, crumbling galvanized nipples, unbonded wiring, subfloor dry rot, or non-code-compliant unpermitted prior work). If unexpected structural or mechanical defects are uncovered during the execution of authorized work:
- Work in that area will pause immediately.
- Our technician will document the condition and present an amended written scope ("Change Order") with revised pricing.
- No additional work outside the original authorized scope will proceed without your explicit verbal or written authorization.
3. Property Access, Environmental Conditions & Customer Responsibilities
To ensure the safe, efficient execution of Services, the Customer agrees to:
- Safe Physical Access: Provide clear, unobstructed access to water meters, main shut-off valves, cleanouts, crawl spaces, attics, mechanical rooms, water heaters, and relevant fixtures.
- Utilities & Power: Provide uninterrupted access to municipal water, electricity, and standard domestic utilities necessary to test, pressurize, and commission plumbing systems.
- Pets & Personal Property: Secure all domestic pets away from service areas and remove valuable or fragile personal property, electronics, or stored items from work zones prior to technician arrival.
- Adult Presence: Ensure an authorized adult property owner, tenant, or designated property manager (age 18 or older) with legal authority to approve work orders and sign authorizations is present during the service window.
4. Emergency Service Dispatch & Winter Freeze Calls
- 24/7 Emergency Dispatch: Emergency dispatch outside standard operational hours (nights, weekends, holidays) is subject to technician availability, road conditions, and severe weather emergency protocols.
- Customer Triage Duty: In the event of an active high-pressure pipe rupture or flood, the Customer is responsible for taking reasonable steps to shut off their main water valve or fixture supply stop to mitigate catastrophic property damage while our dispatch truck is en route.
- Frozen Pipe Thawing: Thawing frozen water pipes carries inherent risks of pre-existing splits or structural ruptures caused by ice expansion. RCR Plumbing LLC is not liable for existing water damage that reveals itself as frozen lines thaw.
5. Drain Cleaning, Sewer Augering & Hydro Jetting Disclaimers
Clearing compromised drainage systems involves heavy mechanical torque and high pressure. The Customer acknowledges the following physical realities:
- Deteriorated & Fragile Pipes: Mechanical snakes and hydro jetting nozzles operate inside pipes of varying age and physical condition. If your drainage system contains aged vitrified clay, deteriorated Orangeburg, rusted-out cast iron, or fragile thin-wall copper, existing structural weaknesses may fail under normal cleaning pressures. RCR Plumbing LLC is not responsible for the collapse, perforation, or separation of pre-damaged, corroded, or root-compromised drainage piping during routine clearing attempts.
- Foreign Objects: We do not warrant drain lines against clogs caused by foreign objects introduced after service, including "flushable" wipes, paper towels, hygiene products, kitchen grease, toys, construction debris, or root re-growth.
- Camera Verification: A drain cleaning warranty (if offered) applies only if an HD fiber-optic camera inspection is performed following clearing to verify the structural integrity of the line.
6. Payment Terms, Late Fees & Mechanic’s Liens
- Payment Due Upon Completion: Payment in full is due immediately upon completion of Services, unless a formal commercial net-billing agreement has been executed in writing prior to dispatch.
- Accepted Payment Methods: Major credit cards (Visa, MasterCard, Discover, AMEX), debit cards, certified checks, personal checks, and approved financing platforms.
- Returned Checks & Processing Fees: Returned checks are subject to a standard $35 administrative processing fee plus any bank fees incurred.
- Late Payments & Collections: Unpaid invoices past 30 days are subject to interest compounding at 1.5% per month (18% per annum) or the maximum rate permitted by Virginia law, whichever is less. In the event collection proceedings or legal action are required to collect unpaid balances, the Customer agrees to pay all reasonable attorney’s fees, court costs, and collection agency expenses incurred by RCR Plumbing LLC.
- Virginia Mechanic’s Lien Rights: Pursuant to Title 43 of the Code of Virginia, RCR Plumbing LLC expressly reserves its statutory right to file a Mechanic’s Lien against the real property where labor, materials, and equipment were furnished if payment is not received in accordance with these Terms.
7. Workmanship Warranty & Manufacturer Limitations
A. RCR Craftsmanship Warranty
- Workmanship Guarantee: We warrant our installation and repair labor against defects in craftsmanship for a period of one (1) year from the date of service, unless a different duration is explicitly stated in writing on your paid invoice.
- Remedy: If a failure occurs within the warranty period as a direct result of improper installation workmanship, RCR Plumbing LLC will repair or adjust the affected work at zero labor cost to the Customer.
B. Materials & Fixture Warranties
- Materials, appliances, and fixtures supplied by RCR Plumbing LLC (including water heaters, garbage disposals, sump pumps, and valves) are warranted solely under the applicable Manufacturer’s Limited Warranty. We assist customers in filing manufacturer warranty claims, but we do not manufacture equipment and make no independent warranty regarding manufacturer defect timelines.
- Customer-Supplied Fixtures: If you provide your own fixtures (e.g., faucets, toilets, sinks, vanity tops, water heaters purchased from third-party retailers), our warranty covers only the labor to physically connect the fixture. We provide zero warranty on customer-supplied parts, missing components, manufacturer defects, internal cartridge leaks, or performance failures of third-party items.
C. Exclusions from Warranty
Our workmanship warranty does not cover:
- Damage caused by freezing temperatures, external acts of God, lightning, electrical surges, or regional water authority pressure spikes exceeding 80 PSI.
- Normal wear and tear, mineral scale accumulation from hard water, or sediment fouling.
- Any system or fixture that has been modified, adjusted, tampered with, or worked on by another contractor, handyman, or the homeowner following our service visit.
- Clogged drains cleared without post-service camera verification where tree roots or line sags exist.
8. Limitation of Liability
To the maximum extent permitted by applicable Virginia law:
- No Consequential Damages: In no event shall RCR Plumbing LLC, its officers, employees, or subcontractors be liable for indirect, incidental, special, consequential, punitive, or reliance damages—including loss of profits, business interruption, alternative living accommodations, or mold remediation costs—arising out of or in connection with our Services or Site.
- Aggregate Liability Cap: The total aggregate liability of RCR Plumbing LLC for any claim arising out of our Services, whether in contract, tort (including negligence), strict liability, or statutory duty, shall not exceed the total amount actually paid by the Customer to RCR Plumbing LLC for the specific service call giving rise to the claim.
- Pre-Existing Water & Mold Damage: We are not liable for water damage, mold growth, or structural rot that occurred prior to our arrival or that resulted from leaks active before our dispatch.
9. Communications, Electronic Notices & SMS Policy
By engaging our Services or using our Site:
- You consent to receive transactional communications via email, telephone, and SMS regarding scheduling, dispatch updates, digital estimate approvals, invoices, and review requests.
- SMS Disclosures: You acknowledge that message and data rates may apply and that you may opt out of SMS communications at any time by texting STOP. For full details regarding data collection and our strict non-disclosure pledge, review our Privacy Policy.
- Electronic signatures, digital checkouts, and email/SMS approvals shall have the same legal force and binding effect as original handwritten signatures under the Virginia Uniform Electronic Transactions Act (UETA).
10. Governing Law, Dispute Resolution & Jurisdiction
- Governing Law: These Terms, all work authorizations, and all disputes arising out of or related to our Services shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
- Mandatory Good-Faith Negotiation: Prior to initiating any formal legal claim, the parties agree to notify each other in writing and attempt in good faith to resolve the dispute directly through informal management consultation for a period of thirty (30) days.
- Venue: Any legal action, suit, or proceeding arising under or related to these Terms shall be instituted exclusively in the state courts located in the City of Roanoke, Virginia (or the Roanoke County General District/Circuit Court, as applicable), and each party irrevocably submits to the personal jurisdiction and venue of such courts.
11. Severability & Entire Agreement
- Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force and effect.
- Entire Agreement: These Terms, together with your signed work order/invoice and our Privacy Policy, constitute the entire agreement between you and RCR Plumbing LLC concerning the subject matter hereof and supersede all prior verbal or written representations, proposals, or understandings.
